Texas Woman Caught Driving In HOV Lane Says Unborn Baby Counts As Passenger

A Texas woman who was ticketed for driving alone in an HOV lane is arguing her unborn baby should count as a passenger.

Plano resident Brandy Bottone, who’s 34 weeks pregnant, says she was driving in the high-capacity lane — which is reserved for vehicles with two or more occupants — on June 29th when she was pulled over. “The officer starts peeking around,” she recalls. “He’s like, ‘Is it just you?’ And I said, ‘No, there’s two of us.’ And he said, ‘Well where’s the other person?’ And I went, ‘Right here.'” The officer gave her a $275 ticket anyway, police records indicate.

Now Bottone is going to take her argument to court, where she’s convinced she’ll win, given the Supreme Court’s recent repeal of Roe v. Wade, she says. “This is a living child, according to everything that’s going on with the overturning of Roe v. Wade,” Bottone says.
